TERMS AND CONDITIONS
Scope of Agreement
This Site is an internet property of Maven Printing, LLC (“Company”, “We” or “Us”). The following terms and conditions are a legally binding agreement. Please carefully review this Agreement as you agree to it in its entirety when you visit our site, purchase products and services from us, sign up for our mailing list, and/or contact our representatives.
We may amend the Agreement from time to time at our sole discretion without specific notice. Therefore, regularly check this page for updates and/or changes.
Orders and Billing
In consideration for the products you order from Maven Printing, LLC, you agree to pay the sums listed at the time such sums are due and owing. All prices are listed in USD. Moreover, by purchasing any products, you will be responsible for paying any applicable sales tax indicated on the Site; Utah Sales Tax is applied to all items delivered to a Utah, USA address. If a customer’s credit card is declined for the payment due, we reserve the right to break down payments into multiple payments until the cost of the items billed/shipped and retained by customer, have been paid in full.
Authorization for Maven Printing, LLC to provide and bill for services and products is obtained by way of your electronic signature, credit card authorization, or voice affirmation. Once an electronic signature, credit card authorization or voice affirmation is submitted, this order constitutes an electronic letter of agency. Our reliance upon your electronic signature is specifically sanctioned by the Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Transactions Act. Both laws specifically preempt all state and local laws that recognize only paper and handwritten signatures.
Shipping and Delivery
Fulfillment generally takes two weeks (after the order is finalized/approved or the online store closes). Once the orders are ready, they will be available for pick up at a designated location or – if the customer paid for shipping – will be shipped out during that same time-frame.
If your order is being shipped to you, as soon as it ships, we’ll email you the delivery tracking information, so you can track the package with the shipping carrier. Orders are generally shipped via USPS or UPS. Delivery within the USA generally takes 2-4 days depending on your location. Please allow for additional time during holidays.
It is the customer’s responsibility to ensure that the mailing address they provide is correct, complete, and can accept package deliveries. You are advised to check if your postal box accepts packages before placing your order (because not all postal boxes do). The shipping carrier also advises that recipients make arrangements so that packages can be left in a safe, secure area. The merchant is not responsible for lost or returned orders due to incorrect, incomplete, and/or invalid addresses. Packages that are returned due to an incorrect or invalid address provided by the customer will be subject to additional charges. After 30 days with no response from the customer, the returned order will not be resent nor refunded.
Return Policy
Each item is custom printed upon order, and only the items ordered are produced. As a result, exchanges and refunds due to incorrect size or color choice, incorrect customization, or other such factors cannot be accommodated. Once an order is submitted to production, it cannot be changed, added to, or canceled. Therefore, be sure to consult the provided item specs as well as carefully review your order before submitting it.
Maven Printing is proud to work with reputable product suppliers and decorators to ensure quality workmanship. If an item is out of stock, Maven Printing has the discretion to use a similar item of the same or greater value as the one originally purchased.
Be advised that due to the nature of custom printed items, exchanges and refunds are only available in the case of a manufacturing defect or production error. If there is an issue with an item when you receive it, please notify Maven Printing immediately, and we will make it a priority to address it. Returns are not accepted after 10 calendar days of receipt of the item or if the item has been used or worn. After that time, exchanges or refunds will be at the discretion of Maven Printing. If an exchange is made, Maven Printing has the discretion to use a similar item of the same or greater value as the one originally purchased, and no refunds are available on exchanges. All sales are final.
Color Disclaimer
Be advised that color representation on the screen can differ than that of the actual item and printed graphic, depending on your monitor color settings. We strive to display as accurately as possible the colors of products and designs in our proofs and on our Site. Due to the inconsistencies of various display monitors, the color you see on your screen may not be a totally accurate reproduction of the actual product or printed graphic. Screen images are intended as a guide only and should not be regarded as absolutely correct. When placing your order, you are acknowledging this fact and waive any claim of dissatisfaction due to color.
Disclaimer of Warranties
Your use of the Site and Company products and services is at your sole risk. The products and/or services offered through the Site and/or from the Company are provided on an “as is” and “as available” basis. All warranties of every kind, whether express or implied, are disclaimed to the fullest extent permissible pursuant to applicable law, including, but not limited to, the disclaimer of any warranties of merchantability, non-infringement, and/or fitness for a particular purpose.
Limitation of Liability
You expressly understand and agree that Company shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential and/or exemplary damages including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses even if Company has been advised of the possibility of such damages, to the fullest extent permissible by law for: (i) the use or the inability to use the Site or the products and/or services offered on the Site and/or from the Company; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, content and/or any other products purchased or obtained from or through the Site and/or from the Company; and (iii) any other matter relating to the website, the products and/or services offered on the Site and/or from the Company. This limitation applies to all causes of action, in the aggregate including, but not limited to, breach of contract, breach of warranty, negligence, strict liability, misrepresentation and any and all other torts. You hereby release Company from any and all obligations, liabilities and claims in excess of the limitations stated herein. If applicable law does not permit such limitation, the maximum liability of Company to you under any and all circumstances will be the amount you paid for the products ordered and paid for on the Site and/or from the Company. No action, regardless of form, arising out of your use of the Site, the products and/or services offered on the Site and/or from the Company may be brought by you more than one (1) year following the event which gave rise to the cause of action. The negation of damages set forth above is a fundamental element of the basis of the bargain between you and Company. Access to the Site and/or the services and products would not be provided to you without such limitations. Some jurisdictions do not allow certain limitations on liability and in such jurisdictions company liability shall be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless the Company and its vendors, and each of their respective members, officers, agents, employees and/or other partners from and against any and all claims, demands, losses, damages, expenses, and costs, including reasonable attorneys’ fees, whatsoever that any third party may make due to or arising out of content you submit, post to, or transmit through the service; your use of or connection to the service and products (including any activity related to your account, including negligent or wrongful conduct, by you or any other person accessing the Site using your Internet account or using Company services and products); your violations of the Agreement (whether alleged or otherwise); or your violation of any rights of another, whether direct or indirect (including without limitation claims for misrepresentation or malpractice).
